Think of it as a legal safety net built into your HR advice.
When you use The HR Dept's Solution service the advice you receive doesn't just come with expertise it comes with insurance built in.
That means if you follow HR Dept's guidance from the very start of a workplace issue and you later end up facing an employment claim including one through Fair Work the insurance can cover your legal and settlement costs you might have to pay.
In plain terms: you get expert HR advice and a financial backstop all in one service.
Imagine your accountant said 'Follow my advice on your tax return and if the ATO audits you because of it I'll cover your legal fees.' That's essentially what this insurance does but for employment law.
This is a simplified analogy to help illustrate the concept actual policy terms and conditions apply.
Three simple steps
When a workplace issue comes up for example a complaint or a performance problem you reach out to HR Dept at the very beginning before you act.
HR Dept guides you through what to do step by step, in line with Australian employment law and the Fair Work framework.
If the employee still lodges a Fair Work claim after you've followed the advice the insurance kicks in covering court costs and any settlement costs awarded against you.
When things go to Fair Work…
If you've used HR Dept's advice throughout the matter and a claim still proceeds the insurance is designed to cover:
- Legal fees and court costs related to a Fair Work claim
- Any settlement payments to an employee
- Unforeseen legal costs that arise when you've acted on qualified HR advice
- Protection for small businesses who can't afford in-house legal counsel
This only applies if you follow the advice from day one.
The insurance doesn't work retroactively. If you've already acted, made a decision or dismissed someone and then call HR Dept the insurance protection won't apply to that situation.
The coverage only applies when you've followed HR Dept's guidance from the beginning of the enquiry. The earlier you involve them the better protected you are legally and financially.
This is built for small and medium businesses.
You don't need to be a big company with an in-house legal team to get proper protection. This is designed for everyday employers who just want to do the right thing.
Taking on employees for the first time and want to start on the right footing.
Wearing many hats with no dedicated HR person.
You're hiring more people and employment law is getting more complex.
You've seen Fair Work claims happen to others and want a safety net.
